  • This Event Photography Agreement (this “Agreement”) contains the entire understanding between Claudiq Photography and CLIENT (as hereinafter defined). It supersedes all prior and simultaneous agreements between the parties hereto. The only way to add or change this Agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this Agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.
    Claudiq Photography is limited by the guidelines and rules of the ceremony official, reception site management and all applicable laws, statutes, ordinances, rules and regulations. CLIENT hereby acknowledges such a limitation and agrees to accept the technical results of their imposition on Claudiq Photography. Negotiation with the officials and/or management for moderation of guidelines and rules and application for and obtaining of any required permits are CLIENT’S responsibility; Claudiq Photography will offer technical recommendations only.
    In order to ensure that the pictures desired by CLIENT are recorded and preserved for them, and to lessen the possibility of equipment or photographer error, there are some poses and group shots that will be taken multiple times and/or with multiple cameras. This is done to ensure that if, for example, a person blinks, weather or lighting conditions change, distractions appear in the background that are not initially seen, or there is a hair, wardrobe or equipment (camera, flash, or some other item) malfunction, then another image or different camera has also recorded a similar image onto digital medium. This means that there will be multiple similar images delivered to CLIENT and should be expected.
    Group photos will require more images be taken than a couple so as to ensure that a great image is captured.
    The larger and longer the Event is, the more digital medium is used due to the "insurance" nature of taking multiple images.
    Multiple cameras. When photographs are taken with two different cameras, each one will have a different type of lens on it. This results in slight perspective changes (for example, a wide angle on one camera and a telephoto lens on the other) and thus also more variety to choose from while performing the "insurance" function at the same time.
    Multiple images with same camera. When this is done, especially on group shots, two or three similar images will occur in a row. Different camera settings are sometimes used to ensure proper exposure which may not always be seen by machine processed prints which "auto" corrects for different exposures.
    Since all digital medium and prints are given to CLIENT, any exposure, framing, focusing anomalies will also be seen and received. This occurrence, though not wanted by the photographer, is guaranteed to occur due to statistics of mechanical, human and situational errors that cannot be overcome. As such the couple should realize that, on average, 5% of frames will be unusable due to any variety of reasons. However, many of these images can be "fixed" using digital editing techniques. Reasonable basic adjustments (for example, color balance, exposure, contrast, brightness, levels and color conversion to black and white) delivered by Claudiq Photography shall be included in the Photography Fee (as hereinafter defined). Any additional artistic work done by Claudiq Photography will be valued, and may be purchased separately, according to Claudiq Photography FINE ART price list available on the Claudiq Photography website.

    1.EXHIBITION: CLIENT grants Claudiq Photography and its legal representatives, successors and assigns permission to display selected images resulting from this assignment as an example of Claudiq Photography work and for entrance into photographic competitions and releases all claims to profits that may arise from such use of the images.

    2.MODEL RELEASE: CLIENT hereby grants to Claudiq Photography and its legal representatives, successors and assigns, the irrevocable and unrestricted right to use and publish photographs resulting from this assignment, including photographs of CLIENT, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. CLIENT hereby releases Claudiq Photography and its legal representatives, successors and assigns from all claims and liability relating to said photographs.

    3.LIMIT OF LIABILITY: In the unlikely event that the Claudiq Photography photographer assigned to the Event (as hereinafter defined) is unable to, for whatever reason, photograph the Event, Claudiq Photography will make every reasonable effort to search for a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability of Claudiq Photography is limited to the return of all payments from CLIENT actually received by Claudiq Photography for the Event package. Claudiq Photography shall take all reasonable measures with respect to exposure, transportation, storage and processing of the photographs. However, in the unlikely event the photographs have been stolen, lost, or destroyed for reasons within or beyond Claudiq Photography's control, Claudiq Photography’s liability shall be limited to the return of all payments actually received by Claudiq Photography for the Event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. CLIENT acknowledges that it is familiar with the Claudiq Photography's portfolio and is requesting services with knowledge of the Claudiq Photography style; that Claudiq Photography work is constantly evolving; that Claudiq Photography services are of unique and artistic nature; that the photos may be different from photographs taken in the past; and that in creating the photos, Claudiq Photography shall use its personal artistic judgment to create images consistent with its personal vision of the Event, which vision may be different from CLIENT’S vision of the Event. Accordingly, CLIENT acknowledges that the photos shall not be subject to rejection on the basis of taste or esthetic criteria.

    4.INDEMNIFICATION: Claudiq Photography is not responsible for any injuries that may occur while shooting in any location. This includes damage to attire (including shoes and wedding dresses). CLIENT agrees to indemnify, defend and hold harmless Claudiq Photography and its subsidiaries, affiliates, predecessors, successors and assigns and their respective officers, directors, members, employees, agents and suppliers (collectively, the “Indemnified Parties”) against and from any all risks, costs, expenses, claims, actions, demands, liability, loss or damage (including, without limitation, reasonable attorneys’ fees) against any of the Indemnified Parties caused by, arising wholly or in part out of, any claim by a third party resulting from (directly or indirectly) or related to any breach of the provisions of this Agreement and/or from the acts or omissions of CLIENT, CLIENT’s employees, agents, invitees or anyone for whom CLIENT is liable.

    5.COMPLETION SCHEDULE: Photograph post processing process may take up to 6 weeks (depending on the season). Creation of an Event album may take up to an additional 4-8 weeks, possibly longer due to laboratory schedules. CLIENT hereby acknowledges and agrees to such estimated timeframes. Furthermore, Claudiq Photography is not responsible in any way for faulty images, typos, misspellings or any other issues of any kind that have been used in a design and approved by CLIENT. If a change or element of dissatisfaction is found after products have been ordered or delivered, the cost of the change or replacement of the product will be at the expense of CLIENT. If the product needs to be returned for any reason, any costs for shipping or for replacement of products will be paid by CLIENT. Claudiq Photography is granted total artistic control over the final design, and any artistic interpretations by Claudiq Photography will be deemed acceptable and correct. Claudiq Photography does not take responsibility for CLIENT'S misunderstanding or misinterpretation of our design services or products. Claudiq Photography cannot be held responsible for dissatisfaction due to circumstances beyond our control. All Event services will be considered rendered after the delivery of the agreed upon Event products. Client is responsible for making a backup of all photos from the digital download/USB. Additional USB drives may be purchased from Photographer. Photographer will make every attempt to keep archival copies of photos, but does not guarantee that they will be retained indefinitely.

    6.CLIENT RESPONSIBILITY: Clients who share photos from their session online are asked to provide credit to Claudiq Photography (For example "Captured by Claudiq Photography") or to use an image that has the Claudiq Photography logo. The clients may print, share, and post photographs online from their online gallery. However, photographs may not be edited or cropped in any way from their delivered format. CLIENT shall select images for prints within eight (8) weeks after Claudiq Photography provides the CLIENT with access to the online gallery. In the event the CLIENT fails to timely select images, the gallery will expire and CLIENT shall pay a fee of $35 to gain access to the gallery.

    7.SECURITY DEPOSIT: This Agreement between Claudiq Photography and CLIENT shall not become effective until it is signed by CLIENT and Claudiq Photography and the Deposit (as hereinafter defined) has been actually received by Claudiq Photography. At the time this Agreement takes effect, Claudiq Photography shall reserve the date and time of the Event and not make any other reservations or accept any other clients for said date and time. In the event of cancellation within 180 days of the scheduled date of the Event, the Deposit and all amounts due to Claudiq Photography as of such cancellation date shall be retained by Claudiq Photography. CLIENT shall also be responsible for payment to Claudiq Photography for any special materials charges incurred up to time of cancellation.

    8.PAYMENTS: CLIENT agrees to timely payment in accordance with the following schedule:

    a. full payment is due at the signing of this Agreement;

    Payments for any additional services and products shall be charged at the order time. Claudiq Photography does not accept any payments made with personal checks. All payments shall be made by cash, PayPal or Venmo. All payments are subject to aplicable taxes.
    Weather conditions, time restrictions, church restraints, lighting conditions and lack of subject co-operation are just some of the factors that make wedding photography an imperfect science. Please be assured that we are anxious to give you the best possible wedding photography, but good photography does not happen automatically. It will take your co-operation and teamwork to help us in this quest. To minimize interference with photographing of the Event, we ask that no friend or relative takes pictures that Claudiq Photography sets up. Please ask them to enjoy the Event as a guest, not as another photographer.
    All Claudiq Photography photographs are copyrighted.

    I have read, understand and agree to the terms and conditions of this Agreement. The Event specific information is set forth in Exhibit A attached hereto and made a part hereof. Each person signing as CLIENT below shall be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement.
    In order for this Agreement to be valid, it must be signed by CLIENT and sent back to Claudiq Photography within 7 days from the date specified below.

If Church officials allow, a quick family session will be taken after the ceremony in front of the altar. Photos will be posted in password protected gallery, each CLIENT will receive access code. All photographs include FREE STANDARD editing (exposure and contrast correction, white balance, cropping).
